Purpose – The purpose of this paper is to analyse the current status of ownership of patient information from a Lockean perspective and then present Datenherrschaft as a new model for patient ownership of patient information. Design/methodology/approach – This paper is theoretical in approach. It is based on arguments derived from Locke’s Two Treatises of Government. Legal examples of the current situation are derived from Finnish, UK and Swedish legislation. Findings – Current legislation concerning patient information is not clearly formulated (...) and so recognising a new right on the part of the patient, Datenherrschaft, would be an ethically justifiable way of remedying the issue. Research limitations/implications – The legal analysis was limited to Finland, the UK and Sweden, and so other legislation should be looked at in future research. Datenherrschaft is used as an example of an ethically justified way of regulating patient information ownership and should be analysed further. Originality/value – Patient information ownership is an issue that is not unambiguously solved in many countries, nor has it, in our view, been ethically justified. According to the received view, Marxian (ideology) critique and Foucaultian (genealogical) critique constitute two divergent approaches of critical theory that have remarkably different goals and little in common. In this article, however, we identify a guiding thread that connects the Marxian and Foucaultian traditions and motivates a distinctive approach within critical theory we call the ‘critique of constitution’. The problem of restricted consciousness, we show, is the core problem in common between Michel Foucault's critical history of thought and Georg Lukács's (...) theory of reification which underlies the tradition of Western Marxism and Frankfurt School critical theory. The problem concerns the limits of intelligibility and, by the same token, the apparent inevitability of the given social ontology. Our sense of what is possible depends on what we are able to think. But we know from the history of sciences that the limits of intelligibility change, thereby also altering our sense of what is possible. This becomes a political problem in connection with the intelligibility of social reality, because our restricted consciousness limits the alternatives we can so much as consider and seek to bring about. The critique of constitution, then, aims to expand the scope of possibility by revealing the contingent formation of the given limits of intelligibility. We argue that this is the paramount political task for Foucault and Lukács alike, other important differences notwithstanding. (shrink)

Many scientific models in biology are how-possibly models. These models depict things as they could be, but do not necessarily capture actual states of affairs in the biological world. In contemporary philosophy of science, it is customary to treat how-possibly models as second-rate theoretical tools. Although possibly important in the early stages of theorizing, they do not constitute the main aim of modelling, namely, to discover the actual mechanism responsible for the phenomenon under study. In the paper it is argued (...) that this prevailing picture does not do justice to the synthetic strategy that is commonly used in biological engineering. In synthetic biology, how-possibly models are not simply speculations or eliminable scaffolds towards a single how-actually model, but indispensable design hypotheses for a field whose ultimate goal is to build novel biological systems. The paper explicates this by providing an example from the study of alternative genetic systems by synthetic biologist Steven Benner and his group. The case will also highlight how the method of synthesis, even when it fails, provides an effective way to limit the space of possible models for biological systems. (shrink)

Background: Enhancing client autonomy requires close coordination of interactional practices between nurse and client, which can cause challenges when interaction takes place in video-mediated settings. While video-mediated services have become more common, it remains unclear how they shape client autonomy in telehomecare. Research aim: To analyse how video mediation shapes client autonomy when nurses guide medicine taking remotely through video-mediated home care. Research design: This is a conversation analytic case study using video recordings of telehomecare encounters. The theoretical approach draws (...) on ethnomethodology and empirical ethics. Participants and research context: Four home-dwelling older adults and three nurses participated in the data collection; data extracts include one client and two nurses. The study was conducted in Finland. Ethical considerations: Special attention was given to protect the rights of home care clients. An ethical statement for the study was given by the Ethics Committee of the Tampere Region Findings: Video mediation complicates interacting remotely with care-relevant artefacts because of nurses’ limited visual access to the medicine and client’s need to simultaneously engage in vocal interaction and medicine taking. This can be overcome by dividing the guidance into manageable steps which invite the client to explicate their readiness to take the medicine and situating the video-mediation equipment and medicine close together. Different interactional practices and ways of situating video-mediation equipment and medicine have consequences for client autonomy. Discussion: Understanding client autonomy in digitalised settings demands empirical examination that recognises the importance of different human and non-human aspects of care that shape client autonomy. Conclusions: To harness the benefits of video-mediated home care, communication technologies’ reliance on home space and interactional practices should be recognised. Empirical ethics research is needed in order to make normative suggestions that fit a wide variety of care situation. (shrink)

When do people say that they are moved, and does this experience constitute a unique emotion? We review theory and empirical research on being moved across psychology and philosophy. We examine feeling labels, elicitors, valence, bodily sensations, and motivations. We find that the English lexeme being moved typically (but not always) refers to a distinct and potent emotion that results in social bonding; often includes tears, piloerection, chills, or a warm feeling in the chest; and is often described as pleasurable, (...) though sometimes as a mixed emotion. While we conclude that it is a distinct emotion, we also recommend studying it in a more comprehensive emotion framework, instead of using the ambiguous vernacular term being moved as a scientific term. A questionnaire was used to assess people's attitudes toward 33 species of animals on six dimensions . A cluster analysis resulted in five groups of animals with similar ratings on these dimensions. Respondents were also asked about their attitudes toward hunting, fishing, and medical, scientific and product-testing research using animals.

Organizations interested in employee ethics compliance face the problem of conflict between employee and organizational ethical standards. Socializing new employees is one way of assuring compliance. Important for longer term employees as well as new ones, however, is making those standards visible and then operable in the daily life of an organization. This study, conducted in one large organization, found that, depending on organizational level, awareness of an organization's ethical standards is predicted by managerial adherence to and organizational compliance with (...) those standards and/or discussions with peers. Regardless of level, organizational commitment was predicted most strongly by managerial adherence to organizational standards. These findings have theoretical implications for the fields of business ethics, organizational identity and organizational socialization and practical implications for the implementation of ethics policies. According to second‐personal approaches to moral obligation, the distinctive normative features of moral obligation can only be explained in terms of second‐personal relations, i.e. the distinctive way persons relate to each other as persons. But there are important disagreements between different groups of second‐personal approaches. Most notably, they disagree about the nature of second‐personal relations, which has consequences for the nature of the obligations that they purport to explain. In the Ancient world poverty was a visible and common phenomenon. According to estimations 9 out of 10 persons lived close to the subsistence level or below it. There was no middle class. The state did not show much concern for the poor. Inequality and disability to improve one's social status were based on honour and shame, culture and religion. In order to understand the activity of Jesus and the early Jesus movement in Galilee, it is essential to know the (...) social and economic context where he and his followers came. The principal literary source in first-century Galilee is Josephus, who provides a very incomplete glimpse of the political and economic character of the Galilee and his account is both tendentious and self-serving. There is no consensus among the scholars on the conditions of ordinary people in Galilee at the time of Jesus and the early Jesus movement. The evidence can be interpreted either so that first-century Galilee was peaceful and people had somewhat better times economically because of the large building projects, or just the opposite - the building projects demanded a lot more taxes and forced labour and made life even more difficult. In this article it is argued that the latter conditions explain better the birth and rapid increase of the early Jesus movement in Galilee. (shrink)

ABSTRACT An influential argument against the possibility of obligations to oneself states that the very notion of such obligations is incoherent: If there were such obligations, we could release ourselves from them; yet releasing oneself from an obligation is impossible. I challenge this argument by arguing against the premise that it is impossible to release oneself from an obligation. I point out that this premise assumes that if it were possible to release oneself from an obligation, it would be impossible (...) to violate that obligation. I note that there are two interpretations of this assumption, one conceptual and one psychological. I argue that, on both interpretations, the assumption is false—at least according to independently plausible accounts of obligations to oneself and of what it means to waive an obligation. My arguments paint a picture of obligations to oneself that not only challenges the argument against their coherence, but also illuminates these obligations’ relationship to other parts of the moral domain. The study of the cultural Cold War and East–West interaction outside diplomacy and high politics has emerged as an important research field during the last two decades. With a few exceptions, however, scholarly interaction has been overshadowed by other forms of interaction. Existing research has mostly paid attention to technological exchange and to espionage, which was at times connected with scientific exchanges across the Iron Curtain. This article discusses scholarly exchanges in the human sciences between Finland and the Soviet Union. (...) Even though Finland was a western-style democracy with a market economy, it had close political ties with the Soviet Union, which allowed for the development of active scholarly connections between the countries. In this introduction to the Topical Collection on Social and Cognitive Diversity in Science, we map the questions that have guided social epistemological approaches to diversity in science. Both social and cognitive diversity of different types is claimed to be epistemically beneficial. The challenge is to understand how an increase in a group’s diversity can bring about epistemic benefits and whether there are limits beyond which diversity can no longer improve a group’s epistemic performance. The contributions to the Topical Collection (...) discuss various proposals to maintain an appropriate amount of cognitive diversity in science, for instance, by recruiting and retaining practitioners from underrepresented social groups, providing incentives for explorative and risky research, encouraging interdisciplinary collaborations and stakeholder participation in research, requiring industry scientists to share their evidence, and developing strategies to encounter politically motivated attempts to manufacture doubt. To be successful, efforts to promote diversity in science should anticipate risks related to institutional interventions, navigate trade-offs between different types of epistemically good outcomes, and identify hidden costs that such policies may cause for various actors. Such efforts need to be assessed not only from an epistemic perspective but also from the point of view of fairness and the political legitimacy of scientific institutions. (shrink)

We examined cynicism as a mediator of the influence of managers’ mission-congruent communication and behavior about ethical standards (a form of supervisory behavioral integrity) on employee attitudes and intended behavior. Results indicated that cynicism partially mediates the relationship between supervisory behavioral integrity and organizational commitment, but not the relationship between supervisory behavioral integrity and intent to comply with organizational expectations for employee conduct.

The article defends the no-harm principle as an intuitively plausible and a common-sense way to justify individual emitters’ duties to take more radical steps in the fight against climate change. The appearance of climate change as requiring large-scale collective action should not lead us astray with respect to the fundamental moral nature of the problem: individual emitters who knowingly sustain and foster the carbon intensive ways of acting also bear personal moral responsibility for the foreseeable climate-related harm and acquire in (...) line with the no-harm principle a direct personal duty to contribute to the efforts of preventing the harm. The article examines more closely the so-called collectivistic approach, according to which emitters’ responsibilities are primarily collective, and argues that without individualistic grounds of emitters’ personal moral responsibility for the harm the collectivistic approach fails to provide unstructured emitters with sufficient reason to act together and fulfil their correlative duty of effective harm prevention. The article argues that since an emitter's personal moral responsibility warrants others to expect her personal engagement in the efforts of effective harm prevention and can justify blame if she fails, identifications of personal responsibility may also significantly increase unstructured emitters’ collective capability of remedying the climate crisis. For several decades, Antonio Gramsci has been one of the most studied and discussed political theorists; however, his originality as a political thinker has not yet been fully understood. On Chang's voluntarist account of commitments, when we commit to φ, we employ the 'normative powers' of our will to give ourselves a reason to φ that we would otherwise not have had. I argue that Chang's account, by itself, does not have sufficient conceptual resources to reconcile the normative significance of commitments with their alleged fundamentally volitional character. I suggest an alternative, second-personal account of commitment, which avoids this problem. On this account, the volitional act involved in committing is (...) one of holding ourselves accountable, thus putting us under to a pro tanto obligation to ourselves. The second-personal account implies that there is an interesting link between commitment and morality. (shrink)

According to Darwall’s Second-Personal Account, moral obligations constitutively involve relations of authority and accountability between persons. Darwall takes this account to lend support to Kant’s moral theory. Critics object that the Second-Personal Account abandons central tenets of Kant’s system. I respond to these critics’ three main challenges by showing that they rest on misunderstandings of the Second-Personal Account. Properly understood, this account is not only congenial to Kant’s moral theory, but also illuminates aspects of that theory which have hitherto received (...) scant attention. “Altered State of Consciousness” (ASC) has been defined as a changed overall pattern of conscious experience, or as the subjective feeling and explicit recognition that one's own subjective experience has changed. We argue that these traditional definitions fail to draw a clear line between altered and normal states of consciousness (NSC). We outline a new definition of ASC and argue that the proper way to understand the concept of ASC is to regard it as a representational notion: the alteration that (...) has happened is not an alteration of consciousness (or subjective experience) per se, but an alteration in the informational or representational relationships between consciousness and the world. An altered state of consciousness is defined as a state in which the neurocognitive background mechanisms of consciousness have an increased tendency to produce misrepresentations such as hallucinations, delusions, and memory distortions. Paradigm examples of such generally misrepresentational, temporary, and reversible states are dreaming, psychotic episodes, psychedelic drug experiences, some epileptic seizures, and hypnosis in highly hypnotizable subjects. The representational definition of ASC should be applied in the theoretical and empirical studies of ASCs to unify and clarify the conceptual basis of ASC research. (shrink)

This paper develops a new kind of approach to conspiracy theories – a procedural approach. This approach promises to establish that belief in conspiracy theories is rationally criticisable in general. Unlike most philosophical approaches, a procedural approach does not purport to condemn conspiracy theorists directly on the basis of features of their theories. Instead, it focuses on the patterns of thought involved in forming and sustaining belief in such theories. Yet, unlike psychological approaches, a procedural approach provides a rational critique (...) of conspiracist thought patterns. In particular, it criticises these thought patterns for failing to conform to procedures prescribed by reason. The specific procedural approach that I develop takes its cue from the Kantian notion that reason must be used self-critically. I tentatively suggest that conspiracy theorists fail to engage in the relevant sort of self-critique in at least three ways: they do not critically examine their own motivations, they avoid looking at matters from the point of view of others, and they fail to reflect on the limits of human knowledge. Activities protesting against major polluters who cause climate change may cause damage to private property in the process. This paper investigates the case for a more international general basis of moral justification for such protests. Specific reference is made to the Kingsnorth case, which involved a protest by Greenpeace against coal-powered electricity generation in the UK. An appeal is made to Rawlsian fairness arguments, traditionally employed to support the obligation of citizens to their national governments as opposed to their international (...) duties. The argument made here, however, is that there seem to be sufficient reasons for holding that a stable climate is one of the first truly global public goods that is indispensable to acceptable standards of living everywhere. This would suffice to justify international and intergenerational 'atmospheric' political obligations, which in turn may justify protests - even those causing some damage to private property - against the laws and policies that violate the fair terms of cooperation in providing a stable climate. The fairness argument aims also to provide a ground from which Green political theory could integrate accounts of radical forms of citizenship into appeals to state political authority. This leads to justifying acts of civil disobedience on the basis of novel understandings of 'atmospheric' citizenship obligations. (shrink)
